The Specialized Nature of International Inheritance Cases 

 

In order to resolve inheritance cases that have an international element, the following issues need to be considered.

1 International Jurisdiction

It is first necessary to determine whether jurisdiction is available in Japan or not – i.e. whether it is possible to file conciliation or adjudication proceedings or a lawsuit concerning that particular inheritance case in Japan.

 

2 Applicable Laws

The applicable law for the case also needs to be determined.

 

In order to resolve international inheritance cases, specialized knowledge of the various issues involved is essential. Therefore, it is highly recommended that you consult an attorney who has experience in handling international inheritance cases and a thorough knowledge of international private law and relevant matters.
