In order to resolve inheritance cases that have an international element, the following issues need to be considered.
It is first necessary to determine whether jurisdiction is available in Japan or not – i.e. whether it is possible to file conciliation or adjudication proceedings or a lawsuit concerning that particular inheritance case in Japan.
The applicable law for the case also needs to be determined.
